This matter is before us on appeal from the trial court's granting of a "Motion for Summary Judgment on Petition for Declaratory Judgment" filed by Ardelia Clark in the probate suit involving the succession of Clark's aunt, Lubertha D. Brantley. On December 10, 1993, Brantley had executed a statutory testament. Brantley died on December 19, 1994. A petition for probate of Brantley's statutory testament was filed by Clark, the alleged universal legatee...
