This matter comes before the Court on the complaint filed by Larry Kondik ("Larry") against, inter alia, First State Bank of Pekin (the "Bank") for declaratory relief. For the reasons set forth herein, the Court hereby grants judgment in favor of Larry and orders the Chapter 7 Case Trustee to turnover to Larry the escrowed proceeds, plus interest earned thereon, from the sale of the subject...
