MATTER OF M.

243 A.D.2d 395 (1997)

664 N.Y.S.2d 551

In the Matter of Juan M., a Person Alleged to be a Juvenile Delinquent, Appellant

Appellate Division of the Supreme Court of the State of New York, First Department.

October 28, 1997

Suppression of the complainant's in-court identification was properly denied since his testimony detailing an encounter lasting at least several minutes and his description of appellant were more than enough to provide clear and convincing evidence of an independent source for such in-court identification (see, People v Williams, 222 A.D.2d 149, lv denied 88 N.Y.2d 1072).
