Ordered that the order dated October 26, 1995, is reversed insofar as appealed from, on the law, the defendants' motion for summary judgment is denied, the complaint is reinstated, and the matter is remitted to the Supreme Court, Dutchess County, for a determination of the plaintiffs' motion to preclude and for further discovery...
