Robert Shank was terminated by Kelly-Springfield Tire Company in November 1994. Kelly-Springfield said it fired him because Mr. Shank filed a fraudulent claim for a refund in contravention of company policy. Mr. Shank said the real reason was his age and brought this suit under the Age Discrimination in Employment Act ("ADEA"), 29 U.S.C. §§ 621 et seq.
