Plaintiffs Magnusson Agency and Michael Magnusson (collectively referred to as Magnusson), sued Public Entity National Company-Midwest (PENCO) for breach of contract and fraudulent misrepresentation, requesting both compensatory and punitive damages. Magnusson claimed that PENCO should have awarded its bid to obtain Webster County's insurance to him, not another agent. The jury awarded damages totaling $180,000.
