Burnell Hendricks ("Hendricks") appeals from the dismissal by the United States District Court for the Western District of New York of Hendricks' 42 U.S.C. § 1983 ("Section 1983") claims of retaliatory prison transfers. Hendricks, an indigent prison inmate who filed his action pro se, argues that the district court erred in refusing to appoint counsel under 28 U.S.C. § 1915(e),
