This appeal is brought by Ricky A. Zorns, appellant, from a judgment of the Court of Common Pleas of Crawford County denying his petition for postconviction relief.

On October 5, 1983, Ricky Zorns fatally shot James Spears outside the Court Cafe in Bucyrus, Ohio. The following month, Zorns was indicted by a grand jury on one count of murder with a gun specification. The state later amended the indictment to delete the gun specification...
