Appellant Fred Sims, age 54, was laid off by appellee Sauer-Sundstrand Company (Sauer-Sundstrand) after more than 27 years of service. Sims filed suit under the Age Discrimination in Employment Act (ADEA), 29 U.S.C. §§ 621 et seq., claiming that Sauer-Sundstrand (1) discriminatorily selected him for layoff because of his age, and (2) subsequently refused to rehire him in retaliation for the charge of discrimination Sims filed...
