We agree with the IAS Court that respondent Department of Personnel's letter of November 13, 1990 gave petitioner unequivocal notice that his Acosta challenge to the Test Validation Board's (TVB) key answers, i.e., his claim that his answers on the test were at least as good as the key answers (Matter of Acosta v Lang, 13 N.Y.2d 1079), had been finally rejected. Under Civil Service Law § 50-a, petitioner then had 30 days...
