The plaintiff, American Premier Underwriters, Inc., appeals from the judgment following the trial court's granting of the motions filed by the defendant National Railroad Passenger Corporation (Amtrak) and the defendant United States of America Department of Transportation (United States)1 to dismiss the five count complaint.2
