The defendant was indicted for two counts of criminal possession of a weapon in the third degree and one count of criminal possession of a weapon in the fourth degree. In response to his motion to suppress physical evidence, a hearing was held at which Police Officer Timothy Keneally testified that at 3:35 A.M. on July 12, 1995, he and his partner were driving a marked patrol car on Duncan Avenue in the Bronx when they saw the defendant riding a green bicycle slowly down...
