At the damages trial of this personal injury action, plaintiff's expert was permitted to testify as to the effect of inflation on any future damages award. The primary issue here is whether CPLR 5041 (e) precludes the plaintiff from presenting evidence of inflation at trial. Defendant also argues that Supreme Court erred in instructing the jury to award plaintiff the value, rather than actual expenditures...
