This matter was remitted to Supreme Court for a reconstruction hearing into defendant's allegation that he was not present at his Sandoval hearing (228 A.D.2d 335). The original hearing transcript discloses only that "a bench conference" was held and that defendant was present in the courtroom, prior to admission of the jury, when the court announced its ruling.
