The two issues presented in this appeal are: (1) whether the trial court improperly denied the defendant's motion to dismiss in which he claimed that his criminal prosecution violated his constitutional right to not be placed in double jeopardy because he had already been administratively disciplined by prison officials; and (2) whether the trial court improperly allowed the jury to decide whether Garner Correctional Institution...
