MOELLER, Justice.

In his first trial, David Scott Detrich ("defendant") was convicted of first degree murder, kidnapping, and sexual abuse. This court affirmed the sexual abuse finding, reversed the murder and kidnapping convictions, and remanded for a new trial on the latter two charges. State v. Detrich, 178 Ariz. 380, 385, 873 P.2d 1302, 1307 (1994). On remand...
