This appeal raises the issue of whether plaintiff Diane Cournoyer ("Cournoyer") was entitled to judgment against defendant Debra Cammarato ("Cammarato") pursuant to Dist./Mun. Cts. R. Civ. P., Rule 56(C) as a matter of law based upon the record before the motion judge. Defendant appealed under Rules 3 and 8C, Dist./Mun. Cts. R.A.D.A. We determine that there is no error and dismiss the appeal.
