I. BACKGROUND

This matter is before the Court on Plaintiff/Appellant's appeal of a Judgment entered by the United States Bankruptcy Court for the District of Colorado ("Bankruptcy Court") on December 5, 1995, wherein the Bankruptcy Court dismissed all claims asserted by Plaintiff at the close of Plaintiff's case-in-chief. The Plaintiff/Appellant ("Trustee") timely filed a notice of appeal
