The appellant, Steven Wayne Tuggle, was found guilty in a jury trial of two counts of criminal trespass in the first degree, one count of burglary in the third degree, and one count of resisting arrest. The court sentenced the appellant to seven years in prison, pursuant to the Habitual Felony Offender Act, on the third degree burglary conviction.
