This matter is before the Court on the defendants' motion to dismiss. For reasons discussed below, that motion is GRANTED insofar as the complaint pertains to the City of Portsmouth. For reasons also discussed below, the defendants' motion is DENIED insofar as it applies to Chief Mook and Sheriff Waters, but that denial is STAYED...
