Before the Court is Plaintiffs' motion for preliminary injunction, wherein, the Plaintiffs seek to enjoin the continued construction of a road widening project ("the Project") currently underway, specifically that part of the Project which would involve the removal of an oak tree ("the Friendship Oak"1) at the intersection of Philema Road and Jefferson Street in Albany, Georgia.
