The plaintiff, Jeffrey L. Cate, filed this action on December 23, 1996, to recover ERISA benefits. In his complaint, he alleges that the defendant, CNA Insurance Companies, d/b/a Continental Casualty Company, wrongfully denied him benefits under a longterm disability plan.

Mr. Cate's employer, FISI-Madison Financial, maintained a self-insured short-term disability plan for its employees, which CNA administered.
