LEWIS v. STATE

No. 96-3127.

695 So.2d 1296 (1997)

Jermaine Demond LEWIS, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fourth District.

June 25, 1997.

Attorney(s) appearing for the Case

Richard L. Jorandby, Public Defender, and Louis G. Carres, Assistant Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Ettie Feistmann, Assistant Attorney General, West Palm Beach, for appellee.

PER CURIAM.

Appellant contends the trial court erred when it modified his probation conditions by directing the probation officer to determine his ability to pay and the monthly payment amount required by his probation conditions.

We reverse the trial court's order modifying the condition of probation. A trial court may not delegate the responsibility for determining a defendant's ability to pay and the amount of monthly payments to a probation officer.
