It is hereby ordered that the opinion in the above cause, as the same appears at 131 Wn.2d 212, 930 P.2d 908, be changed as follows:

1. In the eleventh line from the top of page 214, [First Column, line 24 from top of page 909 of 930 P.2d] the words "are, as a matter of law," are deleted and the word "were" is inserted in their place.
