The case comes before the court on the defendants' Rule 12(b) motion to dismiss for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be granted (Dk.5), the plaintiff's motion for summary judgment (Dk.8), and the plaintiff's motion for default judgment (Dk.11). The plaintiff appears pro se in bringing this action.
