BROWN, Judge.

Philip R. McKinlay appeals his controlled substance convictions. The issue is whether the trial court erred in not suppressing evidence seized as a result of a warrant authorizing a search for evidence of Mr. McKinlay's display of a weapon in a threatening manner toward a low-flying helicopter engaged in aerial surveillance of his property. We affirm.
