Pursuant to Fed.R.Civ.P. 56(d), Plaintiff Don't Waste Arizona has failed a Motion for Partial Summary Judgment on the issue of liability. Plaintiff argues it is entitled to summary judgment establishing that Defendant McLane Foods, Inc. is liable for violations of the Emergency Planning and Community Right-to-Know Act ("EPCRA"), 42 U.S.C. § 11001 et seq.
