OPINION

WALKER, Chief Justice.

Mike Arnold Gutierrez waived his right to a jury trial and pleaded guilty, without the benefit of a plea bargain, to the third degree felony offense of driving while intoxicated. The trial court assessed a ten year sentence of incarceration in the Texas Department of Criminal Justice, Institutional Division.
