The defendants, Midland Risk Insurance Company ("Midland Risk") and Sharon Lemmons, appeal a judgment awarding the plaintiff, Ascension Smith, the sum of $8,000 in general damages, $2,000 for depreciation of her vehicle's value and $1,004.95 for car rental expenses. The trial court also found that Midland Risk breached its duty to fairly and promptly adjust plaintiff's claim and was therefore liable for statutory penalties of $5,000. For the following...
