OPINION

WRIGHT, Justice.

The State charged appellant with criminal mischief and alleged that he illegally diverted gas from Lone Star Gas Company. The jury found appellant guilty. The trial court assessed punishment at confinement for four years, but suspended the imposition of the confinement and placed appellant on community supervision for four years. The court also fined appellant $500. Because the jury was not instructed on the issue of limitations...
