STATEMENT OF THE CASE

Thomas and Suzanne Beemer ("the Beemers") appeal the dismissal of their proposed medical malpractice complaint against Dr. Daniel Elskens ("Dr. Elskens") before the Indiana Department of Insurance.

We reverse.
