Appellant, Beverly Davis, appeals a summary judgment rendered in favor of appellee, Allstate Insurance Company. Davis sued Allstate to recover under her underinsured motorist coverage after Allstate denied her claim. On appeal, Davis asserts that (1) the trial court erred in granting Allstate's summary judgment because there was a fact issue whether her breach was material; (2) the trial court used the incorrect standard of review...
