STATE v. GARDNER

No. 69425.

955 S.W.2d 819 (1997)

STATE of Missouri, Respondent, v. Irvin GARDNER, Appellant. Irvin GARDNER, Movant, v. STATE of Missouri, Respondent.

Missouri Court of Appeals, Eastern District, Division Four.

November 18, 1997.

Attorney(s) appearing for the Case

Gary E. Brotherton, Asst. Public Defender, Columbia, for Appellant.

Jeremiah W. (Jay) Nixon, Atty. Gen., Gregory L. Barnes, Asst. Atty. Gen., Jefferson City, for Respondent.

SIMON, Judge.

Irvin Gardner (appellant) appeals from a sentence entered on a jury verdict finding him guilty of first degree robbery and armed criminal action. Appellant contends that the trial court erred in overruling: (1) his objection and letting State elicit Officer Arnett's opinion that appellant was the man in the surveillance video but then precluded appellant from rebutting that opinion; and (2) his motion to suppress his November 18 statement.
