This cause is before the court on the defendant's motion for summary judgment, the plaintiff's motion for leave to file a second amended complaint, and the plaintiff's motion to extend the discovery deadline. For the reasons set forth below, the court addresses the summary judgment motion aimed at Ms. Humphrey's ERISA claim as a motion to dismiss for lack of subject matter jurisdiction,
