Carol A. Elewski, an atheist and resident of the City of Syracuse, brought this action under 42 U.S.C. § 1983 seeking declaratory and injunctive relief against the display of a crèche by the City in a downtown public park. Having denied Elewski's application for a preliminary injunction, the district court held a consolidated hearing on the merits pursuant to Rule 65(a)(2), Fed.R.Civ.P., and entered judgment against her.
