Defendant, Anatole Nicholas, was charged by bill of information with operating a vehicle while intoxicated, a violation of La. R.S. 14:98.

At his arraignment, defendant pled not guilty. Following a bench trial, the case was taken under advisement; subsequently, the trial court found defendant guilty of driving under the influence of the prescription drug Alprazolam.
