Ernest Saldana was robbed and beaten to death in his Austin apartment on November 3, 1994. Based on this incident, a jury convicted appellant of capital murder, aggravated robbery, and engaging in organized criminal activity. Tex. Penal Code Ann. §§ 19.03(a)(2), 29.03(a)(1) (West 1994), § 71.02(a)(1) (West Supp.1997).1 The State having waived the death penalty, the district court assessed appellant's punishment...
