Plaintiffs filed this action on May 3, 1994 for alleged constitutional violations based on the breach of certain lease agreements for the operation of food kiosks at the Cerro Gordo public beach. Pending before the Court are a Motion to Dismiss (Docket No. 25) and a Motion for Summary Judgment (Docket No. 27) by the defendants.
