Defendant Bryan Stephens was convicted of two counts of unlawful possession of a controlled substance, one count a third-degree felony and the other a class B misdemeanor, see Utah Code Ann. § 58-37-8(2)(a)(i) (1994), and of unlawful possession of drug paraphernalia, a class B misdemeanor, see Utah Code Ann. § 58-37a-5 (1994).
