PUBLIC UTILITIES DIST. NO. 1 v. CREA

No. 19448-1-II.

945 P.2d 722 (1997)

PUBLIC UTILITIES DISTRICT NO. 1 OF GRAYS HARBOR, a municipal corporation, Appellant, v. Timothy D. CREA and Eileen Crea, husband and wife, Respondents.

Court of Appeals of Washington, Division 2.

Publication Ordered October 24, 1997.

Attorney(s) appearing for the Case

Susan Lynn Solan, Brown Lewis Janhunen & Spencer, Aberdeen, for Respondent.

Jon Charles Parker, Parker Johnson & Parker, Hoquiam, for Appellant.

HUNT, Judge.

The trial court assessed $8,870 in attorney's fees against a Grays Harbor County public utilities district (PUD) that had unsuccessfully sued Timothy Crea for $6,570 in damages to a utility pole struck by Crea's car. The PUD appeals the award, arguing that: (1) RCW 4.84.250 does not authorize an award of attorney's fees because Crea did not give notice of his intent to seek such award; and (2) the amount of attorney's fees was unreasonable.
