GRONDIN v. VILLA BISCAYA JARDINES, PHASE II,

No. 96-3217.

692 So.2d 953 (1997)

M.A. GRONDIN, Trustee, Appellant, v. VILLA BISCAYA JARDINES, PHASE II, CONDOMINIUM ASSOCIATION, INC., Appellee.

District Court of Appeal of Florida, Third District.

Rehearing Denied May 21, 1997.

Attorney(s) appearing for the Case

Charles H. Gelman, Miami, for appellant.

Norman T. Roberts, Key Biscayne, for appellee.

Before LEVY and GODERICH, JJ., and BARKDULL, Senior Judge.

PER CURIAM.

We find no error in a trial court holding that condominium maintenance charges levied pursuant to condominium documents recorded in 1974 take priority over a second mortgage recorded in 1980 pursuant to Section 718.116(6) of the Florida Statutes as it existed in 1980.1

Therefore, the order of priority established by the trial court is affirmed.
