OPINION

DAVIS, Chief Justice.

A jury convicted Ascencion Juan Cardona of the felony offense of manslaughter. See Tex. Pen.Code Ann. § 19.04 (Vernon 1994). The jury assessed punishment at five years in prison and a $1,000 fine.

Cardona's three points of error allege that the trial court erred in denying his motion to dismiss the indictment based on double jeopardy. Cardona asserts in his first point of error that his prosecution is barred...
