Ricardo Moreno appeals his conviction by a jury for misdemeanor driving while intoxicated. Tex.Penal Code Ann. § 49.04 (Vernon 1994 & Supp.1997). The trial court assessed his punishment at ninety days in the county jail and a $300.00 fine, enhanced by one prior misdemeanor DWI conviction pursuant to Tex.Penal Code Ann. § 49.09 (Vernon 1994 & Supp.1997).
