Following a jury trial in the circuit court of Cook County, defendant, Robert Cloutier, was found guilty of the first degree murder (Ill.Rev.Stat.1989, ch. 38, par. 9-1(a)) and aggravated criminal sexual assault (Ill.Rev. Stat.1989, ch. 38, par. 12-14(a)(4)) of Alice Cogler on January 28, 1990. Thereafter, a capital sentencing hearing was held before the jury, and defendant was sentenced to death. On appeal, this...
