Plaintiff, James D. Bauer (Bauer), appeals from the grant of summary judgment in favor of defendant, Southwestern Bell Telephone Company (SWBT), in plaintiff's action for fraudulent omission, negligent omission, breach of contract, breach of implied covenant of good faith and fair dealing, violating Missouri Merchandising Practices Act, and civil conspiracy.
