This is a copyright infringement case. Plaintiff Infinity Broadcasting Corporation ("Infinity") owns and operates radio stations and claims copyright protection for all of its broadcasts. Defendant Wayne Kirkwood d/b/a Media Dial-Up operates "listen lines" through which subscribers can listen to radio broadcasts, including Infinity broadcasts, over the telephone.
