Appellant's decedent, Louis H. Carman, was injured in an accident which occurred on the premises of Appellee, Dunaway Timber Company, Inc., on July 24, 1986. He brought this action claiming that his injuries were caused by Dunaway's negligence. Carman died prior to trial and the action was revived in the name of his wife, Suenette Carman, as executrix of his estate.
