MOSELEY, Justice.

Appellant Susan Blum sought relief under Chapter 13 of the bankruptcy code, listing appellee Restland of Dallas, Inc. as a creditor. Restland filed a proof of claim. Three days before her bankruptcy was closed, Blum sued Restland in state court, asserting causes of action arising out of the contract that created their debtor/creditor relationship.
