McRAE, Justice, for the Court:

¶ 1. Richard Dewayne Pleasant was found guilty of capital murder by a jury of the First Judicial District of the Harrison County Circuit Court on March 15, 1995. He was sentenced to life in prison. Pleasant now contends that there was insufficient evidence to convict him of capital murder, that the State improperly changed its theory of prosecution in mid-trial and that his case was prejudiced by the State's mention of gang activity...
