1. Plaintiff Matthew James Griffin, an inmate at the Penitentiary of New Mexico, appeals from the trial court's dismissal of his claims against employees of the penitentiary under 42 U.S.C. § 1983 and the New Mexico Tort Claims Act, NMSA 1978, §§ 41-4-1 to -29 (Repl.Pamp.1996).
